The Right Decision!
I am delighted to see that Justice Sigurdson of the BC Supreme Court has ruled in a follow-up decision in favour of BC government. It allows them to keep the controversially, tough new drinking laws that allow the cops to issue roadside prohibitions without the right of appeal. Many in favour of the earlier ruling that struck down that part as a constitutional infringement do not appreciate the importance of having balance in all legal interpretations. They see only the rights of the individual being the paramount issue here, with the interests of society not counting for very much in the meting out of justice. Consequently, all they see is the need for Victoria to return all the money they have incurred in the form of fines because of the supposedly unfair application of the law. What they don’t realize is that in most, if not all cases, they blew .08 or higher and deserve to lose their licence and vehicles (prevents DUI types from driving under suspension).
